OBJECTIVES AND CONTENTS

Objectives of the Course Unit: This course aims to cover the topics of Civil Code, which is the basis for Private Law, and its interpretation, discretion of court, good faith and provide students an ability to critically analyze in relation to the science of law, as well as the ability to express when personality starts and ends in relation to Law of Persons, how assortment of legal capacity should be done. The student will also be able to explain a person’s rights and their protection, as well as developing practical solutions to existing legal problems. Additionally, it aims to equip students with a competence in solving various legal problems stemming from matters studied as a part of Family Law, which is a part of Civil Code, such engagement, marriage and divorce.
Contents of the Course Unit: The course includes a study of the general systematics of Civil Code and and its fundamental principles as well as natural and legal persons, engagement, marriage and divorce in Family Law, marital property and affinity. This course includes practice (case studies) as well as theoretical information.

The student will be able to interpret the private law.
The student will be able to define good faith and explain its importance in practice.
The student will be able to categorize persons according to their capacity and estimate its effects on legal processes.
The student will be able to define the concept of personal law and analyze when and why it is under attack, and what types of preventive measures can be implemented.
The student will be able to model the conditions to found an association, its organs and the reasons for its cease.
The student will be able to describe the concept of engagement and evaluate the reasons for its cease and the obligations of parties.
The student will be able to list the conditions of marriage and and interpret the reasons for its cease such as nullity of marriage or divorce. The student will also be able to offer practical solutions to common problems in Family Law.
