OBJECTIVES AND CONTENTS

Objectives of the Course Unit: The aim of this course is to equip students with knowledge on the basic principles of constitutional law and the concept of constitution, enabling them to analyse the concept of state, types of states and governments and also the concept of democracy. Also, within the scope of Turkish Constitutional Law; constitutional movements in the Ottoman Era, constitutional progress during the Republic Era, fundamental rights and freedoms based upon Constitution of 1982, and their limits as well as characteristics of the fundamental organizations of Republic of Turkey are discussed.
Contents of the Course Unit: The course includes the origins of constitutionalism, its development and the study of main constitutional systems of the world, as well as constitutionalist movements in Turkey, a comparative study of the Constitution of 1982 with the previous constitutions of the past.

KEY LEARNING OUTCOMES OF THE COURSE UNIT (On successful completion of this course unit, students/learners will or will be able to)

The student will be able to identify the basic principles of constitutional law and its basic concepts.
The student will be able to compare primary constituent power and derived constituent power and describe the process of establishing a constitution.
The student will be able to compare monarchy and republic and interpret the relations between democracy and those two systems.
The student will be able to compare and contrast types of united states including federalism.
The student will be able to describe the systematical structure of fundamental rights and freedoms and explain under what circumstances these can be limited.
The student will be able to illustrate the fundamental principles of Republic of Turkey.
The student will be able to analyze the fundamental bodies of Republic of Turkey; namely, legislative, executive and judicial organs and their operations, electoral system, legislative immunity and presidential elections within the scope of current affairs.
